Responsibility of doctors for Internet consultations
Treatment with video communication will be paid to physicians from compulsory health insurance. Such amendments were introduced in a new draft prepared by the experts of the Internet Initiatives Development Fund. Also, the Ministry of Health and the Commission for the Development of the Information Society participated in the preparation of this law.
Until now, there was no clear definition of this medical service, so it was required to introduce its legislative definition. Simultaneously, the press service of the Ministry of Health noted that the provision of consultations using telecommunications can be called a full-fledged medical service.
It is noted that even now, in case of any complicated situation, doctors call each other and ask their colleagues to consult. But in this case, the entire responsibility for diagnosing and following treatment lies with the attending physician. And doctors who provide telephone consultations do not receive money and at the same time do not bear any responsibility.
In the prepared law a new term is introduced - telemedicine. This is the name given to the service provided in real time, deferred consultations with the remote conduct of both medical and diagnostic procedures. It also includes various medical teleconferences, videoconferences, tele-lectures, teleseminars and other forms of communication that occur with the use of modern means of communication.
The rights of the patient are separately prescribed. In particular, anyone who gives their consent to receive this service( in electronic form) will be able to use such a service, and also need to assure it using an electronic signature. Telemedicine care can be provided both in a hospital( including day care), outpatient, and outside a medical facility. To provide such services, medical workers with secondary medical education, general practitioners, therapists, pediatricians are allowed. Also doctors of narrow specialties can give similar consultations.
For conducting remote consultations, doctors will receive funds from the mandatory medical insurance fund. It is assumed that doctors will be responsible for providing such services and their possible consequences. But there is no more precise information on the planned responsibility in the draft law. Simultaneously, it assumes responsibility from the patient. In particular, it is provided in case the patient reports incorrect data about his state of health or does not fulfill the appointment of doctors.
